Judiciary challenged on electoral disputes handling
A Kenyan top lawyer has urged the Malawi judiciary to recognise its important role in building and stabilising democracy especially when handling elections’ disputes.
Advocate Duncan Okello said the judiciary need to exercise its powers in a manner that is faithful to the constitution and advances democratic principles.
Speaking in Mangochi today (Friday) during the Malawi Law Society (MLS) annual conference and general meeting, the Kenyan said in his keynote address the judiciary need to have courage in undertaking the task so that citizens have faith in its nonpartisan dispute resolution mechanisms that is also faith to the constitution.
“Judiciary needs to be ready to hear disputes that arise and as citizenry we must accept determinations that are arrived fairly. But we also don’t just have to accept the determinations if they are not seen to be guided by the constitution and evidence.
