Court dismisses injunction on KCH houses

The High Court in Lilongwe on Tuesday dismissed a case in which tenants at Kamuzu Central Hospital houses were resisting eviction by the Ministry of Health.

The staff obtained an injunction restraining hospital management from implementing an eviction order by May 31 2014 and sought a judicial review on the matter.

courtBut Justice Fiona Mwale dismissed the injunction and application for judicial review when the tenants’ lawyer failed to show up for hearing.

“This means the Ministry of Health can go ahead to enforce the decision to vacate the houses. It will be up to the management to plan how much notice the two parties should give each other to vacate the houses,” chief state advocate Zolomphi Nkowani said in an interview.

The wrangle over the 25 staff houses at KCH resulted in workers downing tools to force management to evict the tenants who they claimed are ‘outsiders’.
