Court vacates injunction against MHC

The High Court in the northern Malawi city of Mzuzu on Friday vacated an injunction Mzimba and Mzuzu tenants obtained against the Malawi Housing Corporation’s (MHC) decision to increase house rentals last year.

The court last November granted the injunction against MHC, ordering it not to effect the rental hike on condition that the tenants keep paying the disputed additional rentals into court until the matter was determined.

It transpired that after the injunction, some tenants were not paying the old rentals at MHC and the disputed additional rentals into court.

The court ruled that the injunction still stands for those tenants who are complying with the court order and are paying full new rent at MHC or the old rentals at MHC and the disputed additional rent into court.

The court intends to pay back to the tenants the additional disputed rent should the case go in their favour or remit the accumulated rent to MHC should the tenants lose the case.
