High Court stops Mwancheka chieftaincy in Dowa

The High Court in Mzuzu has stopped David Chiwaya as sub-Traditional Authority (STA) Mwancheka Matapira in Dowa and has restrained Jerunsan Banda as the chief until court review.

The court’s order follows the injunction obtained by Banda, who was supposed to be crowned as the chief after he was appointed by President Joyce Banda on the position.

courtThe court heard that the President appointed the applicant (Jerunsan Banda) STA Mwancheka Matapira, which is under Senior Chief Dzoole. However, Minister of Local Government and Rural Development Rachael Zulu installed Chiwaya as STA instead of Banda without reasons for the State’s change of heart

“The orders of injunction are hereby granted restraining the State and minister, their agents, servants or whosoever from treating or recognising David Chiwaya as STA in the area, which is legally under the authority of Matapira. The order also restrains the respondents from ceasing to recognise or treat the applicant (Jerunsan Banda) as the rightful chief in the area under Senior Chief Dzoole,” reads the court order issued by Justice Redson Kapindu of the High Court in Mzuzu.

Banda’s lawyer George Kadzipatike said:

“I can confirm that Jerunsan Banda is now the chief as we wait for the court review to be announced anytime.”
