Man sentenced for 10yrs for defilement
The Mwanza First Grade Magistrate’s (FGM) Court last week Wednesday sentenced 30 year-old Madalitso Bwanali to 10 years Imprisonment with Hard labour (IHL) for defiling a 15 year-old girl.
The court heard that Bwanali who is the husband to the victim’s aunt, during the night of November 25, 2014 entered the girl’s bedroom and forced her to have sexual intercourse with him.
The girl is said to have accepted the demands because Bwanali threatened to kill her if she denied. Bwanali then fled to Mozambique soon after the incident.
According to Mwanza police spokesperson Edwin Kaunda, the matter was reported to Tulonkhondo Police Unit where they referred the girl to Mwanza District Hospital and medical examination showed that the girl was really defiled.
Kaunda said Bwanali returned from Mozambique in March this year and was arrested on the same month after some members of the community tipped the police.
Bwanali who pleaded not guilty to the charges of defilement, was found guilty by FGM Ranwell Mangazi after the state prosecutor Sub/Inspector Jane Juma paraded four witnesses who testified against Bwanali.
In mitigation Bwanali asked the court to be lenient with him because he is a bread winner, but passing the sentence, Mangazi said he could not be lenient with him considering that the young girl will remain traumatize for the rest of her life following the incident.
Madalitso Bwanali comes from Mganga village in the area of Traditional Authority Kanduku in the district.
