Mozambican truck driver fined K800 000 for causing death

 

Dedza First Grade Magistrate’s Court yesterday fined a Mozambican national K800 000 for causing death due to reckless driving.

The court heard that Eusebio Thengu Chavunga, 64, of Mtemangala Chamangala Village, Tete Province in Mozambique hit Jelasi Kalaviyele, 44, of Mapila Village in Traditional Authority (T/A) Kaphuka in the district while driving an articulated truck registration AE 166 MP/MB 4931 on May 10 2017.

Police prosecutor Patrick Chambuluka told the court that upon arrival at Kalinyeke Village along the Lilongwe-Dedza stretch of the M1 Road, Chavunga hit to death Kalaviyele who was herding cattle.

“He hit three cows, two of which were killed on the spot. One of the cows changed direction where it collided with a minibus registration NU 8862. The minibus driver lost control and hit the cow. The minibus overturned in the process,” he said.

Seven passengers from the minibus sustained minor injuries and were treated as outpatients at Dedza District Hospital, according to Chambuluka.

He said a postmortem conducted at Dedza District Hospital showed that Kalaviyele died due to severe head injuries.

Passing sentence, magistrate Enet Banda said the accused deserved a stiff sentence for causing death and injury.
