Mphwiyo shooting case resumes

The High Court in Lilongwe will for the next two days resume hearing the case in which private practice lawyer Ralph Kasambara and four others are implicated in the shooting of former Ministry of Finance budget director Paul Mphwiyo.

Mphwiyo was shot outside his home on September 13 2013, an event which seemed to have unravelled the massive plunder of government resources at Capital Hill later dubbed Cashgate.

However, the prosecution will be in a quandary as their State witness, Mphwiyo, is also facing charges of theft and money laundering of K2.1 billion and tax evasion in separate cases.

Mphwiyo is expected to resume the stand to continue being cross-examined by Kasambara, a former minister of Justice and Constitutional Affairs who is also representing himself.

Ministry of Justice and Constitutional Affairs spokesperson ApocheItimu said as a State witness, Mphwiyo was required to give evidence on behalf of the State. She said the other cases are independent from the current one.

In September last year, the court granted the prosecution permission to add businessperson Oswald Lutepo to the shooting case to be tried alongside Kasambara and others charged with conspiracy to commit murder.
